1. Who This Applies To
The Service is intended for users 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we learn we have collected information from a user under 18, we will delete it. Parents or guardians who believe their child has provided us information may contact us at [email protected].
2. Information We Collect
a) Information you provide.
- Account information (e.g., Apple Sign-In identifier, display name).
- Photos and other content you upload to generate outputs.
- Purchase records processed by the Apple App Store (we do not receive your payment card details).
- Communications you send us (e.g., support emails, feedback).
b) Information collected automatically.
- Device identifiers, operating system version, app version, language, time zone, and approximate region (derived from IP).
- Usage events (e.g., features used, errors, session length) for analytics and reliability.
- Diagnostic and crash data.
c) Information from third parties.
- Subscription and entitlement status from our in-app purchase infrastructure provider.
- Authentication confirmation from Apple (we never receive your Apple ID password).
We do not use the App Tracking Transparency framework to track you across other companies' apps or websites. We do not sell personal information for money. We may share limited information with the service providers described in Section 6 (including analytics and in-app purchase providers) to operate the Service. If any such sharing qualifies as a "sale" or "sharing" of personal information under the California Consumer Privacy Act (CCPA/CPRA), California residents may opt out by emailing [email protected].
3. How We Use Information
- Provide, operate, and maintain the Service, including generating the images and videos you request.
- Process purchases, manage subscriptions, and deliver credits.
- Improve reliability, performance, and safety of the Service.
- Prevent fraud, abuse, and violations of our Terms of Service.
- Communicate with you about support, updates, and changes to the Service.
- Comply with legal obligations.
4. Legal Bases (EEA / UK Users)
If you are in the European Economic Area or the United Kingdom, we process your personal data on the following legal bases:
- Performance of a contract — to deliver the Service you requested.
- Legitimate interests — to secure, improve, and operate the Service.
- Consent — where required (e.g., certain analytics); you may withdraw at any time.
- Legal obligation — to comply with applicable law.
5. Retention
- Our servers. We delete uploaded source photos from our own storage automatically within 24 hours of upload. Generated outputs (images and videos) remain in your account until you delete them or close your account.
- Processing providers. To generate your content, we transmit your source photos to enterprise-tier third-party AI processing providers. Under our agreements with these providers, your content is not used to train their models and is not retained for general logging purposes. Providers may process transmitted content transiently to deliver the result and may retain limited records solely for short-term abuse prevention and service-security purposes, per their own policies. We do not control these provider-side records.
- Account data. Account identifiers, purchase records, and diagnostic data are retained while your account is active and for a reasonable period thereafter to comply with legal, tax, and audit obligations.
6. How We Share Information
We share information only as described below. We do not sell personal information for money. To the extent any sharing described below qualifies as a "sale" or "sharing" under the CCPA/CPRA, California residents may opt out by emailing [email protected] (see Section 8).
- Service providers — We share information with vendors who help us run the Service, including:
- AI processing providers (enterprise tier) that generate your outputs. Under our agreements with them, your content is not used to train their models and is not retained for general logging purposes; they may retain limited records short-term only for abuse prevention and service security.
- Cloud hosting and storage providers.
- Analytics and crash-reporting providers.
- In-app purchase and subscription infrastructure providers.
- Authentication providers (e.g., Apple Sign-In).
- Apple — Purchases are processed by Apple; Apple's privacy practices apply to the payment flow.
- Legal and safety — We may disclose information if required by law, subpoena, or court order, or to protect the rights, property, or safety of Luckycat Club, our users, or the public.
- Business transfers — If Luckycat Club is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction; we will notify users as required by law.
7. International Transfers
Your information may be processed in the United States and other countries where our service providers operate. Where required, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses for transfers out of the EEA or UK.
8. Your Choices and Rights
- Access, correction, deletion. You may request a copy of your personal information, ask us to correct it, or ask us to delete it by emailing [email protected].
- Account deletion. You can delete your account from within the app. Deleting your account removes your stored outputs and account record from our systems; see Section 5 for provider-side residual retention.
- California residents (CCPA/CPRA). You have the right to know, delete, correct, and limit use of sensitive personal information, and to be free from retaliation for exercising these rights. We do not sell or share your personal information as defined by the CCPA/CPRA.
- EEA / UK residents (GDPR). You have the rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with your local supervisory authority.
- Push notifications and tracking. You can disable push notifications in your device settings. We do not use the App Tracking Transparency framework to track you across other apps or websites.
To exercise any right, email [email protected]. We may need to verify your identity before fulfilling a request.
9. Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
10. Children
The Service is not directed to children under 18, and we do not knowingly collect personal information from them. See Section 1.
11. Third-Party Links and Services
The Service may contain links to third-party websites or services. We are not responsible for their privacy practices. Review their policies before using them.
12. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the Service or by email and update the "Last Updated" date above. Continued use after the effective date of any update constitutes acceptance.
